Content License Agreement

Welcome to hiData.

This Content License Agreement (“Agreement”) governs your use of content made available through the hiData platform, including but not limited to photos, icons, illustrations, videos, fonts, templates, and other creative assets (“Content”).

By accessing, using, exporting, or downloading any hiData design that includes Content, you agree to be bound by this Agreement, the hiData Terms of Use, and the hiData Privacy Policy. Capitalized terms not defined here have the meanings given in the Terms of Use.

1. Overview

  • hiData provides Content to assist users in creating designs through the Services.
  • If you do not agree to this Agreement, you must not use, download, export, or otherwise access any Content.
  • All Content is protected by international copyright and other intellectual property laws.
  • hiData and its licensors retain all rights not expressly granted under this Agreement.

hiData reserves the right to modify, replace, suspend, or remove any Content or license at any time.

2. License Grant

Subject to your compliance with this Agreement, hiData grants you a non-exclusive, non-transferable, revocable license to use Content solely as incorporated into hiData designs, for the purposes listed in the following section.

3. Permitted Uses

You may use hiData designs that include Content for the following purposes, without limitation on the number of copies, unless otherwise restricted:

  • Advertising, marketing, and promotional materials (digital or printed);
  • Product packaging and labels;
  • Social media posts and personal or commercial online content;
  • Websites, blogs, e-books, and electronic publications;
  • Books, book covers, magazines, newspapers, editorial content, videos, broadcasts, films and other entertainment materials;
  • Posters, prints, flyers, postcards, greeting cards, and similar materials (including for resale);
  • Educational projects (school or university);
  • Device backgrounds (desktop or mobile);
  • Templates used exclusively within hiData;
  • Any other use expressly approved in writing by hiData.

All permitted uses must comply with applicable laws and hiData’s Terms of Use.

4. Prohibited Uses

You must not use any Content (whether free or paid) in any of the following ways:

(a) Redistribution and Resale

  • Sub-license, resell, lease, lend, transfer, donate, or otherwise distribute Content or any rights granted under this Agreement (in accordance with Article 5), except as expressly permitted;
  • Make Content available for download, extraction, or standalone use (including thumbnails), on websites, or provide content for sale

(b) Branding and Ownership

  • Use Content as part of the trademark,logo, service mark, trade name, or brand identity (excluding fonts where permitted);
  • Claim ownership of Content or imply that Content was created by you or anyone other than the rights holder;
  • Remove or alter copyright, trademark, or proprietary notices.

(c) Editorial-Only Content

  • Use Content marked "for editing only" for any commercial, advertising, promotional, or sponsored purposes;
    (In this agreement, "for editing only" refers to content concerning newsworthy or public-interest events, and excludes advertising use of any kind.)

(d) Offensive or Harmful Use

  • Use Content in connection with pornography, obscenity, defamation, hate speech, violence, or unlawful activity;
  • Use Content in a manner that is misleading, defamatory, or harmful to individuals or entities depicted;
  • Use Content in connection with:
    • Adult entertainment services
    • Tobacco products
    • Dating or escort services
    • Political endorsements
    • Medical, healthcare, pharmaceutical, or dietary supplement advertising

(e) Competitive and Technical Restrictions

  • Use Content in any manner that competes with hiData’s business;
  • Enable extraction, copying, or reuse of Content as electronic files;
  • Reverse engineer, decompile, or disassemble any Content containing source code;
  • Use Content in peer-to-peer sharing, on-demand product platforms, or file-sharing systems;
  • Use Content for machine learning, artificial intelligence, facial recognition, biometric identification, or similar technologies;
  • Use or display Content to leave an impression that the content is created by you or someone other than the copyright owner of the content (including but not limited to declaring the ownership or exclusive right of the content);
  • Use Content for machine learning, artificial intelligence, facial recognition, biometric identification, or similar technologies.

5. Attribution Requirement (Where Applicable)

Where attribution is required, you must involve the following credit near the Content or in production credits:©[Insert contributor name], from hiData.com;

6. Front Software License

hiData includes font software (“Font Software”) as part of the Content. In addition to the restrictions in Article 9, you must not:

  • Install or use Font Software outside of hiData or exported hiData designs;
  • Modify, convert, adapt, or redistribute Font Software;
  • Use Font Software independently of hiData;
  • Reverse engineer or attempt to access the source code, except as permitted by law for interoperability purposes.

7. Termination and License Revocation

  • hiData may monitor usage to ensure compliance with this Agreement, including through monitoring downloads and exports, tracking private hiData designs, and any abusive use of username and password.
  • If you violate this Agreement or any hiData policy, hiData may suspend or terminate your account and revoke this license without prior notice.
  • Upon termination:
    • All rights granted under this Agreement immediately cease
    • You must stop using all Content and hiData designs containing Content
    • You must delete or destroy all copies of such Content and designs
    • Paid fees will not be refunded where termination results from a violation

You may voluntarily terminate this license at any time by ceasing use and destroying all Content and hiData designs, and any copies or files or accompanying materials (if applicable).

8. Infringement Claims

If you become aware of any claim, actual or potential, that Content infringes third-party rights, you must:

  • Immediately stop using the Content at your own expense;
  • Remove the Content from all systems, storage, and platforms;
  • Ensure third parties (e.g., printers or service providers) do the same;
  • Promptly notify hiData at copyright@hiData.ai

9. Disclaimers

  • Free Content may not include model or property releases. hiData does not grant rights to names, likenesses, trademarks, designs, or private property depicted in Content.
  • You are solely responsible for determining whether releases or permissions are required for your intended use.
  • Metadata (titles, keywords, descriptions) is provided for convenience only and is not guaranteed to be accurate.
  • Content and Font Software are provided “as is,” without warranties of any kind, except where consumer protection laws require otherwise. It is not guaranteed that the Font Software does not have any defects, errors or omissions.

To the extent permitted by law, hiData and its licensors disclaim all liability for indirect, incidental, consequential, special, or punitive damages. hiData and its suppliers (including Font Software suppliers) shall not be liable for any loss of profits, data loss or any other indirect, incidental or consequential damage to you or any other party under any circumstances.

10. Survival

The provisions relating to ownership, restrictions, disclaimers, liability, termination, and compliance obligations shall survive termination or expiration of this Agreement.
